Advice needed: Nanny share and bank holidays

I have a lovely nanny who I use Monday - Wednesday, and she works for another family Thursday/Friday. What's the form on bank holidays, because obviously she is entitled to paid bank holidays, but I'm going to be the one penalised since I always use her on Mondays.

Does one just pay the bank holiday and it's just unlucky the days I use her for, or is there another compromise - sharing bank holiday pay with the other family perhaps?

Any advice welcome since I don't want to short change my nanny, but also don't want the double whammy of having to pay for days I don't use her for.

You really should have thought of this before and tbh you have to just pay up.

No she isn't. You could ask her to work on a bank holiday. An employer does not need to give a bank holiday off. An employer is able to request that the employee takes the day as annual leave.

It will depend on what it says in the contract.

What does your contract say with regard to holiday entitlement?
Statutory holiday entitlement is 5.6 weeks, which CAN include bank holidays.

Does your contract say anything about holidays?

If not, the statutory minimum applies. 5.6 weeks at 3 days a week is 16.8 days which cannot be rounded down so I would make it 17 days.

If she doesn't work bank holidays, these come out of the 17 days.

The other family should give her 5.6 x 2 = 11.2 (so 12 or 11.5 days) holiday, which again might include Good Friday, Christmas/Boxing/New Years day.

Technically it is not a nanny share - it is 2 seperate employments as she never works for you both on the same days.

As MrA says, you would split the holidays as he has set out.

Have you thought about sick pay? Do you have any in your contract? If SSP only then no problem, but if you have written some into it think about what you will do if it is a Mon -Weds that she is off.

I work part time and they pro - rata the bank holidays. So you get 3/5 of the standard number of holiday days which is 28 plus 3/5 of the total no of bank holidays in a year. Then I have to take a full day's holiday on any bank holiday that lands on a working day.

NOt sure if this is the same as Mr A. is saying but it is fair.

Legal minimum holiday is 28 days - pro rata'd for part time workers, so you are getting extra melli
