CM -Deposit HELL

Please help, I am a NCMA member and use there contacts, never had a problem before, but now, theres always 1 family that want to push there luck.
In Jan 18 a CM boy was meant to start at my setting, but his mum rang to say she had to go back home and needed me to keep his space, so I asked for a holding deposit, no problems she paid for a 2 wk holding deposit, and signed to say he start on 1 Feb, I also said she had to pay a 4wk deposit to cover 4wk notice period, all signed and agreed,
In the grey box I ticked HELD AS A PAYMENT DEPOSIT which she signed. and agreed,, well I have only recieved the holding deposit of 2wks and 2wks toward the deposit.
Now she has handed A 4 wk notice, so I text her to say she could leave this week as she has only paid the 2wk deposit and she asked me for a refund of 2wks, which i have replied NO because it was to hold the space and thats my wage for those 2 wks she was away and in actual fact she owes me 2wks.

Please tell me am I right?

I am wondering if there is some confusion due to your use of the word deposit. It was't a deposit... it was a retainer fee. It was a charge to keep the childcare place available. Maybe the parent didn't understand that... maybe they thought it would be something that got returned at a later date.

Throughout the whole conversation she understood everything, i showed her all the writing evrything and she signed knowing this BUT she has no pulled the card out that she doesnt understand english, which in fact is an even bigger lie.

sounds like you may have to cut your losses for the extra 2 weeks, however i would stand firm on the lot she has paid and re iterate that she signed and fully agreed and understood at the time..you hold the contract to whihc she put her signature on, doesnt matter if shes now changed her mind, its too late!...ive also had parents like this 8-(
