Bank holiday pay for p/t nanny - have I got this right?

Ok - so I know its 28 days holiday pay per year inc bank holidays. Pro rata for my 2 days-a-week nanny this is 11.2 days holiday pa inc bank holidays.

My p/t nanny works mon & fri, so of the 8 bank holiday days this year, 7 will fall on days she's theoretically working for me. She and I are both in agreement that she won't be working on those days. So that means she gets 4.2 days remaining paid holiday to take at other times, yes?

Other threads seem to suggest that the normal compromise is for half of the holiday days to be chosen by the nanny, and half by the employer - so does that mean that in practical terms we pick a week and she picks a week (and then we sort out the 0.2 days in cash or a short day or something?).

And then on top, if we're away extra days and don't need her, we pay her anyway.

Am I right, or am I in a tangle? Thanks!

There is no entitlement to having Bank Holidays off.

I agree with you that 7 days of Bank Holidays (or substitute day) will fall on a Monday or a Friday over the next 12 months (Feb2010-Feb2011).

Thus you are within your rights to request that she does not work those days and takes them as part of her annual leave. Therefore leaving her with 4.2 days.

You can't sort the 0.2 days in cash. Rounding up I feel would be more usual, to something that was sensible given the working hours. That may mean rounding up to a half-day or a full day.

Given that you do not want your nanny to work on the bank holidays - your choice - then I would suggest you let her choose the time off for all of the remaining days. As she is mutually agreeable to having the bank holidays as days she is off, then you could agree to choosing one week (2 days) each from the remaining days and then seeing if the .2 of a day is used somewhere, such as nanny leaving early one day, or you not needing them for a full day at some point, or them requesting time off for something unexpected.

Any additional times you decide you don't want her to work, will be payable in full... just like the annual leave is fully payable.

Does that make sense?

Yes... 5.6 weeks entitlement, which is 28 days for someone working 5 days a week. See here.
