Au pair legalities inc contract

Sorry to ask another au pair question, but here goes!

I just downloaded the au pair contract from aupairworld.net but obviously cannot be sure that it is up to date and legally meaningful. If anyone else has hosted an au pair and used a contract, please could they advise on the general content of it - in fact, if anyone has a blank copy of their contract that they could share then that would be very useful, but really any advice on this area and its potential pitfalls would be fab.

Thank you in advance!

Unless they've changed it since last year the contract on aupairworld has never been 'legal' in the UK (it refers/referred to a european treaty that has never applied to the UK).
I've used a variety of contracts - as long as you cover the basics - pay, perks, period of employment, hours of employment, notice required, annual leave, duties you should be ok. (There is a nanny contract on nannyjob.co.uk which lays things out in a clear fashion).
I have to admit I have based current au pair's contract on one I got from another mumsnetter I think I have an anonymised copy that I look out and send to you if you accept CAT.

Millarkie, it would be fab if you could share it. I was struggling to understand a lot of the intricacies of the APW one. Yes, I've subscribed and accept CAT. Thank you for your help!!

Just realised that you put your email elsewhere on MN so have used that - quicker than CAT.

Ah, I should have added a correction to that thread - the e-mail address is actually ecook23 @ hotmail . co. uk(without the spaces) rather than .com. Unfortunately pregnancy has turned me into an idiot who cannot remember her own e-mail address. Really sorry but would you mind re-sending your details? Thank you very much

That explains why it bounced! Will try again

Mill - if you are using the contract I sent you I have since updated it following some of the advice that others posted here (special mention to Mr Anchovy but others as well).

can I have a copy of contract too- all helping my research. I am able to accept CAT. (I have been posting asking some questions too and am reading other posts with interest- all very informative). I thought that if you are not an employer (below the threshold) that you do not need a contract but that you should document your agreement in some form so that it is clearly set out in writing. I have read conflicting posts on this and it sounds safest to take a written document format

blimey · 06/01/2010 10:02

dadinsteadofmum could I have a copy of the contract you use as well please?
cheers!

DadInsteadofMum · 06/01/2010 11:26

Gallery you are an employer in legal terms, legal is different from tax registration which is what the thresholds are about. You need to have some form of written agreement, it doesn't have to be a formal "contract" but needs to cover the basic requirements of emplyment law.

DadInsteadofMum · 06/01/2010 11:27

People that want the contract please CAT me as I can't send attachments via CAT and would prefer not to post my email address here.
