CMs - 'Rising - 5' clause on Ofsted registration certificate

Have just had a new 'condition of registration' added to my certificate called the 'Rising - 5' clause, which covers cms who look after children in Reception class - probably introduced after last years confustion about numbers and ratios following 'EYFS' . It states -

'when caring for 4 or 5 year old children who are in full time education, may increase the number in the early years age group by the number of children in full time education, providing the maximum number is not exceeded [Early Years Register]'

I saw it on several recent inspection reports 0n their website and rang Ofsted to find out more about it. It must be new because my inspector recently didn't have it added following inspection and she was aware I have Reception children in my care.

You have to apply in writing for a variation, asking for the 'Rising - 5' clause to be added to your conditions. It took mine a week to come through - quick for Ofsted . Especially important if you care for summer children who will be 4yrs for most of reception - should stop people thinking you are over numbers .

No other cms round here had heard of it - Ofsted being inundated with variation requests now

I haven't got room on my certificate for another clause

"The registered person:

  • when working with two other childminders at the above premises, may care for a total of no more than 12 children under 8 years; of these, not more than 9 may be in the early years age group, and of these, not more than 3 may be under 1 year at any one time (Early Years Register, compulsory part of the Childcare Register)
  • may care for no more than 6 children under 8 years; of these, not more than 3 may be in the early years age group, and of these, not more than 2 may be under 1 year at any one time (Early Years Register, compulsory part of the Childcare Register)
  • must not provide overnight care (Early Years Register, compulsory part of the Childcare Register, voluntary part of the Childcare Register)
  • may leave an assistant alone with children for short periods of time providing the arrangements are agreed and confirmed in writing by parents and the requirements of the Early Years Foundation Stage continue to be met (Early Years Register)
  • when working with an assistant, may care for no more than 12 children under 8 years; of these, not more than 6 may be in the early years age group, and of these, not more than 2 may be under 1 year at any one time (Early Years Register, compulsory part of the Childcare Register)"

Haven't heard about that, but having just done a search have found it on some CM's certificates - Example
Are they perhaps adding it following doing an inspection?

They didn't on mine Nick & I had 2 rising 5's at the time

True, I was just looking at yours... maybe it was because your inspection was in March, not April (although report was published in April).

Nick, I only found out about it from Ofsted inspection reports when I went through my manic post-inspection stage .

KatyMac - no wonder you posted recently about a 2 page inspection report .

Hmmm - have I started something . Sorry Ofsted.........

Registration certificate - am sure your inspection report was way, way longer than 2 pages

I have that on my certificate - because of my OWN DD! Honestly, they have no idea sometimes. It says that I can care for 5 children in the early years age group when one of those children (ie dd) isn't at school! Still confused about it now but after so many discussions I decided to leave it be!
