Just a quick moan, it appears that one of my families have knowingly or unknowingly been claiming more than they should be for childcare and have been found out, so now they are down on this months payments which means they can't afford to pay me this month. I filled all the forms in correctly, told them what I do and don't charge for and it seems that my figures don't add up to their figures. What to do? I'm waiting for NCMA's legal department to reopen but don't think they can tell me anything I don't already know.

Hi hennipenni - that's the question - did they or didnt they know?

Regardless they have used your service and owe you money, it's a shame that they are short this month - but I don't see why you should be too . Other thing is that if they have been receiving an overpayment for some time (and it can mount up quickly) they will no doubt be on reduced TC till it's paid back, this being the case it might wise to be firm from the beginning as I suspect if they have been used to getting x amount they will be used to spending it too - as we all do

Thanks awnw, my thoughts are that they knew. Have just spoken to NCMA legal people, apparently the only way round it is for me to say I want full payment by x date or I will have to give notice which means they will owe me a months fee's anyway. I thought I may be able to refuse to give care until I've been paid but appently that opens up the channel for the parents to sue ME for loss of earnings!

hennipenni - it's all a bit bonkers isn't it sue you for loss of earnings? isn't it the other way around! YOU are supplying a service at a cost, YOU are not a charity or vlountary organisation it's YOU who are not getting paid why doesn't NCMA sue them for loss of earnings - they make me mad at times if they don't pay on time as per your contract then they are in breach of said contract therefore is contract valid ? imo I wouldn't hesitate to refuse care, especially if you are of the opinion that they knowingly made a fraudulent claim - wonder what else you don't know about

Have told parents I need half fees by Friday and the balance by the end of the following week otherwise I will serve notice.

To cover yourself, I would put it in writing too and get them to sign to say they've received written notification.
