a cm friend of mine is minding 6 children under 5, she has an assistant. she also minds 1 4 year old who is at school and 1 3 year old who is at full time private school. she says because the 4 and 3 year old are at school all day all week they count at over 5S, if this right!!

The 4 year old, I think yes they are 5 for ratio purposes.
The 3 year old, not so sure.
What country are you in?

EYFS Framework, May 2008 edition says:
"of these six children, a maximum of three may be young children, however where four- and
five-year-old children only attend the childminding setting before and/or after a normal school day, they may be classed as children over the age of five for the purposes of the adult:child ratio;"

hmmmmmm. she is saying that because the 3 year old goes to pre school 5 days a week she counts as a rising 5. she must be over her numbers? waht should i do.

gently point out that she is practising in contravention of her registration certificate. her insurance will be of no force or effect should the worst happen.

If she got an asisstant she could have up to 6 children under age of 5 if the ofsted happy whith that,for me as cm i could childmind up to 2 children under age of 5 one could be under 1,when i work with asisstant i could have 2 more under 5 another one could be under 1 so i think she is ok
