They have produced a document - it's called "Follow up to the Local Authority briefings" - & of course I can't find it on the OFSTED website - these paragraphs are the problems - 65, 72, 74, 88, 94, 95, 96, and 97

Basically if there are more than 4 of us during a day we are not childminding anymore

The council won't allow us to run daycare or nursery provision in my house do I am basically stuffed.

Just been reading some Tribunal decisions. The tribunal takes consideration of what is in the National Standards, so therefore I expect they would take consideration of what is in the EYFS documents. However, I don't think they would take notice of what was in some question-answer session held with local authorities.

I can see that Ofsted need to define the difference between a childminder and a nursery. But I am not sure they are going about it in the right way. Seems unreasonable to class someone as a childminder on x date, but a nursery on the day after. Wasn't there some mention of a transitional period?

Alas I think you may need to wait until Ofsted decide to take action - and then if they take action to close you down, you then take it to tribunal and get a ruling on it. Painful way of doing it, but what is the other option... making someone (or a few people) redundant, which may result in a drop in number of childcare places provided, which may result in insufficient income being generated, which results in closure.

Perhaps Ofsted want you to decide for yourself to close down, as that will be a lot easier for them. If you resist them - they then have to fight you at a tribunal, and take their chances on if the tribunal would agree with them, or not. The resulting tribunal could then be referenced in future by others in a similar situation.
