Do Nurseries/CM have to report accidents to Ofsted/HSE

Is there an obligation for a Nursery to report a serious accident? DD fell and cut her head badly, she will be off for a week maybe.

If this was an accident at work and one of my employees was hurt I would have to report it to the Health and Safety Executive.

Is there any rules about Children in daycare and accidents?

I just want to know what they should be doing so I can make sure they have done everything they should. I believe they are investigating the accident atm so I am awaiting a report before I meet with the Manager and make any decisions about DDs future care.

Yes, it should be reported to Ofsted and to their insurance company too, so it can be logged in case of future problems or claim.

Minor scrapes, cuts etc do not, but this ssunds a bit more serious. Hope your DD is better soon.

Yes serious accidents reported to Ofsted, and written in book, and there is somewhere else you report it to too, will try and rememeber...

Thanks Alibubbles - Do you know if there is a document on the ofsted site that outlines what should and should not be reported?

I have had a look but could not see any specific guidance.

As for a claim - well I can't see that they did anything wrong - unless there was not enough carers in the room but I doubt they would admit that. Their first aid was fine and they contacted us immediately. I think her keyworker has been a bit traumatised as well. I think she will be paying them all a bit more attention in future!

RIDDOR is the other place - www.hse.gov.uk/riddor/

That might just be for childminders though.

I hope your DD will make a quick recovery poor thing.

Thanks Kay - that would be helpful, all I could find was about making complaints - which I will do with the Nursery if their report does not cover everything I would want to know.

RIDDOR (Reporting of injuries, diseases and dangerous occurences regulations 1995) They will be given a number when they report it.

RIDDOR is what I follow at work if there is an accident. This would fall under an over 3 day injury as she can't attend for more than that. I was not sure if it covers Children at Nursery though.

Right so both seems to be the answer. I will call both now and check what I should expect the Nursery to do and by when.

I have caught them not following procedure before when DD fell down and cut her lip so I am being a bit more thorough this time. I also want to be fully informed before I meet the Manager so she can't fob me off like last time.
