childminding contract.

Hi,

I have been charged for bank holidays, in the contract that we both signed it says that bank hols are not applicable (she doesnt work them) but now she has produced a sheet from her folder that states she does charge for them but if it isnt in the contract then surely that doesnt count?? any advise gratefully accepted please!!

I would say if its not in the contract then it dosent stand. Or else why have a contract?

If it doesn't say it in the contract then I do think she can charge you for them.

I always make sure I tick the correct box in the contract and make sure the parents are aware of it

I think it is in my CM contract, and we do pay her for bank hols. I'm afraid it's standard from most CMs - either that or they charge you a heftier daily rate but don't charge for hols. In my case it worked out cheaper to go with the CM who charged for holidays.

But you're right - it should be in the contract, and she should have discussed this with you before you signed. I think you may have to come to an agreement.

she has just put n/a next to the public holidays also next to her own holidays. she has also said she wont work them so common sense tells me that she can't charge for a service that she doesn't provide. Thought I was being a thicko!

Think you need to clarify with her what was meant by n/a on the contract. Seems what you thought it meant, differs from what she now feels it meant. Once that has been clarified, then come to some agreement, else it's time to look for another childminder.

i charge for bank hols but dont work them as a rule, this was 'the given' when i was training..if i DID work them i would cahrge double time, but as a lot of my parents are off or can get alternative care on bank hols(the grandparents dont have to do the school run) we dont ususally have a prob..i do however change the day for one mindee as her only day with me is a friday, so on good friday she comes on a thursday.

If its not in the contact she cant charge it!

I have the boxed ticked with the charge at retainer.

theres been alot of chopping and changing her side not mine i even changed my hours to suit her so perhaps this is a blessing and a good excuse to look for someone else.

Sounds like that might be the case. If she thinks she can just change things without consulting you then I'd start hunting another one out.

It is common to charge for bank holidays but it should say clearly on the contract you signed. I agree with you that it doesn't matter what her folder, notice board, website or anything else says (unless there is reference to the other source in the contract you have signed)

I know other childminders and parents have been confused by NCMA contracts, don't know if they've improved but the last one I saw wasn't very clear on bank holidays at all.

you're right Ayla, the contract isnt easy to understand, even for a cm it made me wonder what i was ticking when i came to the box re b.hols, so i put a disclaimer underneath saying bank hols are not normally worked but if child normally comes on one of these days normal fees apply, if worked double normal rate applies.
