Can you be self-employed and work as a nanny?

Just looking for ways my nanny can stay on legally in this country. Could she register as self-employed... and...um continue to live and work with/for us...? Seems like a no-brainer, but I have GOT to find a way to keep her.

Any advice appreciated

No, it is unlikely that a nanny will meet the requirements for being self-employed - due to the amount of control you have as the employer, lack of being able to provide a substitute, being a live-in worker, etc. It is possible for a nanny on rare occasions to meet the self employed criteria - Ladymuck I think, posted about it a while back - but very unusual, I feel.

I also doubt it would change immigration status - would being Self Employed really change immigration status (if that is what is needing changing, so they can stay in the country longer)?

What details can you provide... for example, their nationality and why they can't stay in this country legally. Are they currently here (I assume you are in the UK) on a particular type of visa?

What's the problem? How long has she been here? Can she leave and come back again?

she is bulgarian, which means that she can only work as an au pair if she is under 27 years old. our nanny is 34 . she can work in the uk as self-employed, but it looks like that is not an option. she is here as a 'tourist' for 3 months, which gives me time to find a solution. any ideas???????

Does not look good... seems to me that she would need to apply for an Accession Card and you as the employer would need to apply for a Work Permit (for her to be your nanny, not an au-pair). Not looked at it closely, but I think you would have to prove that the job vacancy could not be filled by someone resident in the EEA.

I feel it's a non-starter... so if you need childcare, start looking now for a new nanny, childminder or nursery.
