What's the legal position about a private (paid) childcare arrangement?

One of my friends has asked me if I'd like to look after her DD who is the same age as my DS (2.7) a couple of days a week. I'm not really up for being a fully-fledged childminder but our children get on well and I could really do with some extra cash. Just wondering though if it's legal?

No it's not, assuming you would be in your home, whether you are paid or get a favour in return. Had you been a direct relative you may have been able to do so, unpaid at least. You should be registered as much for your protection as the children's (insurance etc)plus you can claim tax relief on some expenses.

To make it legal, you need to care for your friends child at your friends home. Then you are a nanny and can be paid (your friend is then your employer).

Assuming you are in England... if you care for your friends child at your home and you are paid, that is only legal if it is on 5 or less occasions in a year (see exemption for occasional facilities - Care Standards Act 2000.

As Lizs says, if the care is only for a short period of time (less than 2 hours in any day) then that is OK. It's when it is more than 2 hours per day, that childcare regulations start to kick in.

Why not have both children at your friends house, that way it is perfectly legal as you will be a nanny In reality you will probably find you are out and about with them most of the time anyway.
