Child maintenance help

My ex has my child 3 nights every other week. This is via a court order and it's a shared care arrangement.

Child will be starting school in September - and all holidays will be split equally.

I have not claimed any CMS but will look to file an application this summer - does anyone know how I would calculate if I am entitled to anything?

There is a calculator on the cms website that is easy to use

Go on calculator

how come not been claiming when you e had more nights?

Lotusflower08 · 25/04/2023 15:21

I haven't claimed anything so far as he has been contributing to the rent but has now given notice that he won't anymore - I didn't want to rock the boat as I'm sure he would have deducted any CMS he would have to make from the rent he was helping with.

I have a lives with/lives with order with my ex over our child - I wanted to go on a weeks holiday which he is obstructing for no valid good reason. The holiday would be impacting one overnight for him with our child in the 7 days and he is stating that he won't grant permission due to missing time with child.
I have offered the night back upon our return and encouraged him to also take child away for a week however he is choosing to abuse the court order to obtain more time with child that what was ordered - ie il give you the holiday if you give me xyz.
Is he allowed to do this?! I see on google that a lives with order means we don't need to seek permission from either parent but I still gave me so much notice etc and he's still being difficult.
Can he stop me?

I think he can. At least, I wouldn’t take the risk that he wouldn’t. My ex is like this so I only make plans during our time together. My DC have different contact patterns and it can restrict what we can do together but I take that on the chin rather than giving him
more control over me.

can you do the same?

Argh so frustrating - the split of our holidays is only in force from September when child starts school - so I wanted to take one holiday before the school holidays start to take advantage of the cheaper prices for one time before September. Just so unnecessary of him to do this.

Of course it is unnecessary but he doesn’t want to be reasonable or fair. My advice is to stop expecting him to be and work around him, the only way to deal with difficult exes is to make their attempts at control pointless, I always see it like removing another tentacle of his from me.
