Term time contracts and inset days

Morning everyone,

I have a term time contract with an after school nanny. Are INSET days covered by that (included, so can I expect her to come home just not doing the pick up) or not?

INSET days are not part of the school term, i.e. they are outside the 195 taught days for pupils but ARE part of the teachers' contract. They happen during term time for the schools' convenience.

You will need to ask your nanny.

Term time generally does not include inset days for support staff. The contract should specify about inset days. At my school some support staff do have it written in to their contract that their role is term time plus inset days and/or plus x weeks holiday working (if the school want them to work inset days and/or during the holidays). If the contract is just term time or term time plus x weeks holiday working then they would not be expected to work inset days.

Teachers are different and do have to work inset days.

No. I am a teacher and had a term tone only contract with nursery for my childcare. I used to pay extra for inset days.

My TTO contract is written as TTO+5 - to cover the inset days.
I wouldn't think that an after-school nanny would cover inset days without prior agreement - she could reasonable be expected to be free until 3pm, and so have other priorities before then. I wouldn't be surprised if she was expected to cover from normal collection time, but wouldn't expect her to work an extra 6 hours each inset.

If someone is doing before and after school care, having them do all day is a significant change.

I would expect the working days to be based on the school calendar, so an INSET day would be like a holiday... the child is not at school.

You can agree whatever you like with your employee but if they are doing before and after school care, not all day, then they may not be available all day. When you agree the working days, if the school has given dates of when they are open and closed to pupils, then use that to discuss with your nanny what days you need childcare and the hours of work.

Generally I would say a before/after school nanny would not be working on an INSET day, as the child is not at school.

I was an after school nanny many years ago. You most definitely should not assume your nanny will be willing or able to do (school) hours that they wouldn't usually work without considering this an extra that you ask them if they're happy to do and that you pay them their usual hourly rate for.

I expect my normal hours on training days unless booked and paid for separately
