Assistants during holiday? .

Hi ladies,

If you're a childminder do you pay your assistants in the holiday?
And If your an Assistant, do you get paid in the holiday?

Just that really.

I considered having an assistant but didn't go with it because it was too expensive. A childminder's assistant is an employee and as such are entitled to holiday and sick pay plus pension contributions. Here is a link to the government advice re who is self employed Vs employed.

I'm currently an Assistant and wanted to know whether it is normal to not get paid in the holidays. I know I'm not actually working during holiday but what's the difference between the childminder and myself if we both don't work in the holidays but she's getting paid by government and parents whereas she's made me on a contract to only get paid during term times, I do also have bills to pay sadly.

Sorry this isn't meant to be a rant but just for information to know if this is actually the norm.

I would say if the business is not open during the school holidays then you would not be paid for them just like school staff as not paid in the holidays. Do you get paid monthly what you have worked or are your wages spread across the year ?

I would also say if your contract at is just term time only this is what you would be paid for even if she is working in the holidays but does not need you.

I worked in a school before and was getting paid monthly but spread across the year and that meant in the holidays as well as the long summer break, so this is abnormal for me. As far as I know, agencies pay you term time only. This work is calculating per hour so only getting paid what I've worked that month.

I would say that you will be entitled to a pro-rata amount of holiday.
So say a full time person gets 4 weeks plus bank holiday. Work out the hours they work a year, calculate your hours per year and then work out the percentage you are of a FTE. From here you should be entitled to that percentage of holiday pay/percentage of paid bank holidays.

You’re on a term time only contract you get paid term time only. You need to arrange to have your salary spread over the year or save monthly yourself to cover the holidays.

She won't be paid by the government if shes not got children. Funding is only paid for the weeks shes open. If parents pay her for her holiday it's nothing tobdo with your contract. Most school staff are not paid for thec13 weeks the schools are shut but the pay is spread out over the year. My daughter works in preschool and is thd same. Read your contract. You will get holiday pay but it may say you are paid for x weeks to be taken in school holidays.

If you’re employed on a term time only contract you’re still entitled to holiday pay, it’s something like 12% of working time. So if you work 38 weeks you should get paid 42.5 weeks. The rest is unpaid leave.

my assistant is term time only. The agreement we have is I pay her 4 additional weeks as her holidays.

I explained this during the hiring process.
