are nannies legally entitled to breaks?

atm our nanny has an hour's break when ds1 naps

wondering what will happen when he drops his nap

i guess sole charge nannies can't have breaks, but how come laws don't apply to them?

surely she doesn't have a real break? She can't leave the premises can she if her charge is asleep?

no, she sits and reads/watched tv

she works alongside me so is not sole charge

There are exemptions for some parts of the Working Time Regulations, but I can't find an exemption for 12(1) which is to do with having a 20 minute break after working 6 hours.

However, if the nanny was alone with the children, they could hardly leave the children while they took a 20 minute break. So I do wonder if there is a work-around somewhere.

I would expect most nannies to accept that their role prevents some legislation from being practical - and thus they won't take you to tribunal if you don't give them their 20 minute break.

Breaks are not the only issue, there is also working more than a 48 hour week.

Not sure what the soluition is... as your nanny isn't sole charge, you could give your nanny a 20 minute break after they have worked 6 hours.

i have it in my contract that im entitled to take a break at a time when it wont harm the children

Ie if they are asleep or watching TV etc

i very very rarely take a break at all though, except for this acedmic year as my eldest is now at school and my toddler still has a nap.

normally i do some cooking during this nap though

I think it is possible to sit down at some time while nannying - babies and toddlers sleep and older children are capable of sitting looking at books or watching videos for a little while
