Nanny maternity leave change in hours

Hi everyone, I’m a nanny currently on maternity leave. My boss has told me that upon my return my charge will be attending nursery 4 days a week so they are effectively telling me I will be going from full days to before and after school care with no pay in between.

Does anyone know if this is legally ok? Or do they have to make me redundant? The new hours don’t work for me as it will be a significant pay cut, so I would like to take redundancy if possible.

Sorry to make the clearer, no pay in between nursery drop off and pick up. So effectively going from being paid for 11 hours work a day to 5 hours

I would say that is a significant change in job so a redundancy situation could occur if you do not take the new hours.

Have a look on Maternity Action and ACAS websites, those tend to be good places for maternity queries.

That's a redundancy. I can't believe people still don't know these basic things. Do they use a payroll company? I know it is upsetting but they totally can't do this just like that so just take things step by step.

Their needs may have genuinely changed but they have to go about things the right way. Nannies are an expensive childcare solution for most people and will include costs like this, often, over the period of time . It's just how it is, rant over!

Thanks everyone, I feel like I can argue my case now I know I’m right. I’ve been there 3 years so can claim redundancy.

I think their needs genuinely have changed (funded hours have come into play), I don’t think they are intentionally trying to be difficult but I’m fed up of having to fight for and explain basic things like this to every employer I’ve had. They seemed genuinely shocked that I wasn’t ok with the new hours they’ve set for me Confused

Flo, I'd put it in an email to them initially if I were you. Then discuss in person. These discussions have a habit of getting a bit fraught.

I would agree to the idea of putting it in writing. 'Now I've had time to reflect on your changes requirements it does sound like a different role and no longer meets my needs in terms of total hours worked'.

Might it work for you OP if you could bring your baby with you and still retain the same hourly pay? Or a combination of doing a couple of full days (with baby and then doing nursery duties in between). It may work for both of you. I would also put it in writing.

Otherwise, yes you're perfectly entitled to redundancy payment.
