I need to know what the new law is concerning bank holidays. Will they be required to be paid?

I know that now you can give them the day off, pay her for it, and then you can credit it towards the 4 weeks of hols. But, I think this is ending.

Nick, I thought just the minimum wage was exempt for live-ins. Not aware of any other employment rights that don't apply.

I have calculated nanny's holiday entitlement based on 24 days (but crediting paid bank holidays towards the 24 days) from 1st Oct. So, I think I'm in line with the law.

  • from 1st Oct. 2007, you have to give 24 days of hols
- from 1st Oct.2008, you have to give 28 days of hols - Bank holidays can still be credited toward the holiday entitlement.

However, I am now curious about the law for au pairs. If I hire an au pair from an EU country, do I have to give her 24/28 days of hols in addition to bank holidays? Are au pairs from EU countries covered under employment law or do people just pay them in cash?

(Is it a thread hijack if I change the subject on a thread I started?)
