Hey there!

I'm a nanny and need some advise please guys!

I had started a new nanny job two weeks ago, I was sent a draft contract through email by the parent on the first week. The next day of receiving the contract, I told the father that I had signed the contract and would hand it back to him to sign too. Hw told me he'd print another copy for them to keep.
Anyway to keep it short they paid me my salary weekly & all taxes etc was also paid for. Today I turned up to work only to be told "we decided not to go ahead with the contract, you've been lovely but our child is having issues adspting to a new nanny".

How rude is it to dismiss someone on the same day, at the door, without a reason?

So I basically have a contract with my signature only. Do I have any rights?

Even if the contract is binding, it will say there’s a probationary period.

Generally in the first month you can be fired with no notice. It’s basically a trial period for the job.

I’d be surprised if your contract doesn’t mention a probationary period.

Contract says 1 month probation, 1 weeks notice for both sides.

Then they owe you either 1 weeks work, or 1 weeks monies.

You can be fired for anything under 2 years

For wearing the wrong coloured shoes.

Notice during probation is often quite short. Looks like you have a 1 week notice period in the contract, so they should pay you for work done plus 1 week in lieu of notice.

Initially write to them requesting pay in lieu of notice for the 1 week notice as per the contractual agreement, plus you want payslips and the P45. They can then seek advice from their payroll provider... who I feel would agree that one week notice pay is due.

Hi there, sorry to hear your news but I think you need your signature and theirs on both copies of the contract, one you then keep and one they do otherwise it's not legally binding.

Phone ACAS for advice. I think you could take the parent to small claims court for the week's wage that you have not been paid. Re contract: doesnt matter if you havent got the signatures.

The written contract is only proof of your agreement, which exists regardless of the signature on the piece of paper. Just contact them to ask for your P45 and no doubt it will include the third week’s wages as their accountants will advise them to that effect. You could also mention it, but do do very politely as you will need a reference.
It would be worth trying to get some feedback on why they terminated so fast, in case there is something you can do differently next time (not saying that there is, it could just be the impending recession, but it would be useful to know, for you).

I can smell bullshit here, from the parents part. So they need a nanny, right? If they get a new one after you, the child will struggle with her too. So why get rid of you? They want to start the whole struggling process with another person? Don’t you think they just wanted to get rid of you for another reason?

Speak to ACAS or CAB.
If you have proof that they’ve drafted the contract via email that might be interpreted as their agreement to the terms of it.
