Holiday quandary —advice much appreciated !

Wondering whether bank holidays are usually included in the statutory holiday allowance for a part time nanny (couple
Days week) or given as extra? what’s the norm / is acceptable (London)? Thanks !!

Legally they can be part of Statutory Holiday as described in the contract of employment.

What is norm? I don't know. I worked New Year's Day this year and that's a Bank Holiday but the parents needed me to work.

Generally the bh are worked out - ie if a Monday worked and taken off

If not then any bank hols that do fall taken off then split the remainder

The standard contract on nannytax has all bank holidays plus 20 days as the standard allowance. If your nanny is part time there is also a calculation of pro rata holiday.

I think the norm is 20 days annual leave (half the days are chosen by employer, and half by the nanny) plus any bank holidays that fall on the nanny’s normal working days.

So if the nanny works Tuesday and Wednesday, for example, any bank holiday Mondays are irrelevant to them and they are just ignored. But if eg Christmas Day falls on a Wednesday then they would get that day off.

8by8 that is wrong, actually.
Minimum Holliday allowance is 28 days Year. Whoever needs to work on BH still has 28 days but taken on different days (if working on BH)
So a nanny working 2 days a week is entitled to 2/5 of 28 days = 11.2 days a year.
By your example if nanny works Tue and Wed and in years when Christmas day and NYD would be Thursday and Boxing day on Friday she would miss out on 3.2days of paid leave ( 4 weeks x her working 2 days only would give her only 8 days)
28days (pro rata) is a statutory minimum -and has been for a long time ...
The whole '4 weeks + BH' only works for full time employees
OP it is up to you to agree with your nanny if she gets BH off as part of her holiday allowance but they can never end up with less holidays then 28 days pro rata (off course you can always give her extra paid days off...If you wish)

@swlondonnanny - thanks, I’d obviously misunderstood that. Our nanny is full time anyway so thankfully not an issue here.

We always just gave our nanny the option - either they could book them off (as part of their 50% choice), we could book her to have them off (out of our 50% choice), they could work them or the could have them off unpaid.
I did always bring it up a couple of months before the bank holiday, just to remind them.
