I've had the same nanny for three years and she's due to go on maternity leave soon
Does anyone know

  1. What her statutory pay rights are
  2. Should I pay her more to keep her happy? What's the norm? Do nice employers offer longer maternity or a longer period on full pay?
  3. She wants to bring her baby with her to work when she returns. Should I get a discount? What's acceptable if any?

She has all the same rights as you would have in your work (assuming you work and are not self-employed). Therefore Maternity Rights information can be found at DTI Website - Maternity Entitlements Guide .

No view on question 2 I'm afraid. If you offer more than SMP and the nanny decides not to come back, what happens then?

There is no right for your employee to bring her child to work with her. The job would in my view become a NannyShare and thus you can renegotiate on how much you pay.

Nice employers do offer better than SMP, but sensible ones put a clause in saying that if she doesn't return and stay for 6 months then anything over and above SMP has to be paid back

  2. No. Unless you can afford to and want to.
  3. Yes, you should get a discount. Treat it like a nannyshare. You must give her back her job. But, you don't have to let her bring the baby with her.

Hey, I guess this is an advantage of a male nanny... not likely he'll turn up preggers.
