Self employed nannies - how to contract?

I am about to hire a self employed nanny. (She's got a letter from HMRC.)

Just wondering if anyone knows how to do the contract? It's not an employment contract obviously! But it seems like a very good idea to have a contract.

If she is self employed she should be supplying you with her terms and conditions and a contract.

Just because she has a letter from hmrc stating that she is self employed & has a UTR number it doesn't mean she will be self employed for you - it entirely depends on how you will be using her services.

Will she be working regular hours dictated by you or will you be using her for ad hoc/temporary childcare as and when she is available.

She should issue you with her terms & conditions including her quote/hourly rate, cancellation terms & terms of payment. She should invoice you at regular intervals.

Anyone can register as self-employed. Employment status is specific to the job and not the person.

If she's working for several families at once, is a maternity nurse, temp nanny or doing ad-hoc then she could do the job on a self-employed basis, otherwise you'd probably need to employ her.

I mentioned on another thread recently that you can just ring HMRC and ask for a decision on employment status on 0300 123 2326.

If she is se she will have her own contract and give you her terms and conditions and fees etc
