Childcare vouchers to pay maternity pay for nanny?

Our nanny had been with us for over six months. It was a condition of her employment that she get ofsted registered, however, she has been dragging her feet on this and is still not registered. So both DH and I have lots of money tied up in childcare vouchers and are having to pay her each month. The problem is, that she is now pregnant and going off on maternity leave in a few months. We are therefore going to be seriously out of pocket having paid her insurance, application fees etc.

Having never had to pay statutory maternity pay, my question is, can we pay this using the vouchers if she eventually sorts out her registration? I know I can claim the maternity pay back from the government, but not sure if that comes to us as a cash lump sum, leaving us free to pay her in vouchers?

I think you're very good, I would have lost patience by now.

The new online DBS is fairly quick, even our new committees voluntary DBS's have come through within 6 weeks. I wonder if there's something worrying going on (i.e. she has some kind of conviction).

They will issue a new certificate if it has been lost in the post so she just needs to contact them. That should be doable within the next 4 weeks.

Personally, if it were me, I would give her notice that she can only be paid with vouchers from the 1st January and therefore she must become registered before then.

OP I have asked you several times on here if you have seen her First Aid and Childcare qualification. But you have not answered me. So I'm assuming you haven't seen these.
If she doesn't have these then she will not get the Ofsted Registration.
The DBS is irrelevant.

Sorry Florence, yes, we did see them. Her first aid certificate ran out shortly after she started with us, she told me she went on another course but, I have to admit, I didn't ask to see the new one, as I had no reason to doubt her.

Ok, so an update...she has managed to get her DBS by going round to her previous house and collecting it. The problem
Now is that she has missed the 19 day time window to register forbthebupdate service so ofsted won't register and she needs a new DBS, which from her recent text she is expecting me to pay for. I'm really annoyed about all this. Surelybitvwss her responsibility to track her application online and change her address when she moved?? What would you do about it?

Don't blame you for being angry; I wouldn't pay if I was you.
As a nanny I pay my own Ofsted , First Aid and insurance.

She moved house and did not get the mail re-directed. Royal Mail offer a redirection service, why didn't she use it given she knew she was in the process of getting a DBS check done.
She pays for the new DBS in my view.

So given that I've already paid, and she won't realistically have time to sort this out before she goes in maternity leave (so no point applying for another DBS) is it reasonable to ask for half the money I've forked out back? Given what's written in the contract, I could ask for it all back but don't want to seem vindictive.

Is she entitled to mat pay? Given that she's only been working for you for 6 months and is on mat leave soon.

I would be very pissed off and would not pay again

Why didn't she redirect her mail?? I did for 2yrs possibly even longer

She should pay but bet she won't so yet as terms of contract she should pay back the money you have spent

I'd be tempted to give her her notice and make her pay the money she owes for the insurance etc
Use your vouchers to pay for your new childcare.

You only have to be employed for 1 week before pregnancy begins for the employer to be responsible for your mat pay iir rm0054

OP, I think you are within your rights to ask for it back. I'm amazed you forked out in the first place, I've always paid my own.

I think it's right the employer pay for ofsted as they are the ones who Benifit from the vouchers. The nanny doesn't get extra pay

Saying that if a nanny left within the year I think it's fair they pay back half as can then be used on another family

Seems This nanny isn't bothered about the voucher scheme and as it was part of her contract it needs to be sorted

As she is preg it's hard to dismiss her - tho surely if she hasn't done what she agreed to do and been 6mths you have the right to give her notice as she didn't follow terms of contract

Maybe post in employment and ask flowery for advice

Sorry yes, employee to pay ofsted fee (though I think given nanny has messed about I think she should ask for it back) ..I thought op had said she'd paid for other things.

Your right. Op did say she has paid assorted costs - I assumed only the £103 for ofsted

Anything else - ie first aid and pli the nanny should pay herself

I would send her a letter giving her 7 days to apply for a new DBS and a month to complete her ofsted registration. I would also say that if she fails do these things you will immediately terminate her fro breach of contract and she will be required to reimburse you for all of the money you have paid towards her registration.

Although personally I think I would be terminating her regardless, if she can't do a simple thing like fill in some forms in a timely manor i would be seriously questioning her other abilities.

I agree with everyone else she needs to comply with her contract and do it and now pay for it herself. But as you say prob no point as may well not be through in time.

Yes give her a week to apply for her Dbs (mine took 3 weeks to come back and that was with getting my id checked the day after I applied online and with only 3 addresses to check) I then applied for my ofsted as soon as it came back and it took 10 weeks for my certificate to come through (can take upto 12) and is now going to take between 1-2 weeks for the voucher companies to have everything up and ready to be paid with them and once it is all done, the vouchers themselves can take up to 4 working days with one of the companies my bosses are using to get into my bank account so it does all need to be sorted by the middle of a month ready for payday.
