Does an au-pair have to live with the family? What if they live on their own, but have breakfast, lunch and snacks with the family?

If they are non EU, do they have to have working rights on their student visa?

How are they paid?

They won't be an au pair if they don't live with you.

An au pair is someone who who lives worth you and sort of mucks in. So a bit of child care and a bit of housework and they get pocket money rather than wages.

This is quite good info and links to a home office guide.

Max hours 20 a week, some will be more restricted than that so you must check visa status. NI and Income tax rules apply as per usual, as does National Minimum Wage. They will need a national insurance number.

An aupair lives as part of your family, so they won't be an aupair. They could be your live-out nanny.

Looks like working hours restriction applies to term time only.
