Do I need a DBS check?

I am coming out of nursery work to be a nanny.... I have had about 3 CRB checks (and proof of them) over the years, but my current one will run out next month.

Do I need to get a new one to work as a nanny? The family that are interested have said that they're not bothered if I have one or not, because I have worked in childcare for so long, they don't need to see the proof. However, is there a legal obligation to have one? Or is it ok to work with children without one?

As a nanny there is no legal obligation unless the family wish you to register with OFSTED, in which case you will need one but OFSTED will do their own. It's up to the family.

Checks are only valid on the day they are printed.

New checks should be done for each new employment, though it is up to the employer, they could say that your existing check is ok for now and then get another one done once you are in the job. However, it is hard for private employers of nannies to get a DBS check done.

Ofsted registered Home Childcarers will have a DBS check done as part of the application process. That I believe Ofsted consider is kept up to date. However if you intend to do multiple jobs, change job quite often, it is probably worth registering for the update service (register for that as soon as possible once the DBS process is started as once certificate is printed there is only a short period of time in which to register for the update service).

DBS Regulated Activity Factsheet (pdf) - looking at that, nannying should be a regulated activity but unless the nanny is Ofsted registered I suspect it is up to the employer. Having had a quick look, I can't find a specific exemption.

If you and your new employer are happy and they are not going to be using Childcare Vouchers or Tax Credits, then not having a DBS check done is I think up to the parents.
