Nanny - Resignation and pay

I am going to give my resignation in tomorrow. I have tried to be up front with mum. Telling her I was unhappy over a period of months. We both talked and tried to resolve but same issues kept coming up. I felt relationship had irrevocably broken down and very quickly got another job. Again I told mum as I wanted to give her plenty of notice in finding a replacement.
I told mum would be resigning officially as of Friday and asked what she would like to do about holiday owed. She the called her children 'vile' whilst they we're get bathed. They asked me what it meant. When children in bed mum had her computer out and was telling me 'I' owed her pay!
I am so disappointed. I have worked for them for 20 months.

DO you owe them money? When does your holiday year run from and have you already taken more than your pro-rata amount for this year? I wouldn't worry too much if she employs a payroll company to do your payslips as they will calculate it correctly. If she does it herself and you think she makes incorrect deductions from your final pay, you may have to enter into some strong correspondence with her!

She does use payroll company. So I can check with them them? I used HMRC holiday calculator and it said 1.8 days owed. That is 2 days?

New to 'foruming' - made up new verb!!!!

On leaving the holiday would not be rounded but paid. Your employer could roundvto 2 days and give that off during your notice period but they don't have to do so.

To calculate holiday you would need to refer to what had been taken so far this holiday year. Holiday year starts day of first working unless written agreement says otherwise. Holiday can not usually be carried over year to year, so if you have been there 20 months then you would nedd to look at the last 8 months.

Thanks Nannynick. Yes, I worked it out for the eight months. Total 10.8. I have taken 9 days.
Regarding owing her pay. I work 34 weeks at 21' hours and 18 weeks at 30 hours. £10 phg
As I will have only worked 8 weeks of 18 then I owe her money? As '
unexpected' said payroll will probably be able to tell me?

If you get paid the same amount each month then yes you could well owe her money as you will of been paid for hours not yet worked. So the holiday owing may well off set that amount to some extent so you may not owe as much if any. If you do different hours term time and holidays how is your holiday calculated? I would work out number of hours holiday owed and then take off number of hours taken to see what is left.

Holiday is calculated 5.6 x 3 day. Total 17 days

I am just so cross that mum (what is code for mum?) is being so pedantic. I gave more time freely to them. I looked after their children with my other job on occasion both sets of parents paid Each other, not me! and I was not paid extra.
It does seem that being nice, helpful and obliging leads to nanny being taken for a ride.

I truly makes me want to finish the month get my pay for this month and not go back.

Sounds complicated as you do different hours different weeks. I would have expected holiday to be calculated in hours, not days as on some days during the year you work more hours. But then you may also take time off during certain times, so a day off in the longer hours weeks is worth more than a day off in the shorter time week.

The payroll provider may not be told anything about holidays, it depends what your employer does and what she gets e payroll company to do.

Is your pay averaged out over the year, so you get roughly the same each month? That could easily result in an over or under payment upon leaving.

Yes it is averaged out over year. Same amount each month.

I have usually taken holiday off in 18 period.

Oh well! Looks like nothing to be done.

At least I have new job to go to. Contracts all signed etc. I am really looking forward to it.

Think positively about the new job. Try to come to an agreement on the old job, it may be very tricky to work things out, pay and holiday would need to be done on what has actually been worked so far this pay year.

If you take your holiday on what would be your longer hour days then you actually end up with more holiday then the statuary norm. As you should add up all the hours you work in a year and times it by 12.07 to work out how many hours you are owed at statuary min which would Ob give you more days off if you took the hours off on your short days.

If you work it out that way you may find you have actually had more holiday than accrued esp as you have only worked 8 months out of 12

In next job will not do 'favours' of extra time and running around. Now know to keep it business like.

Well back in to work tomorrow with mum from hell. Hope I can keep my mouth shut. I left my phone there on Wednesday as I was so cross I left
( at my finish time).
Sent an email apologising for that. Not heard anything back though.

Sorry. I know what you mean though about knowing better next time, I had a boss once who would let me go 5-10 mins early every now and then but would add them all up and get me to do an extra hour in return at hardly any notice, and another family that when I left I said about owed holiday and they said we only owe you half of that as we let you go 1/2 hr early everyday you worked (was only there 8 weeks as really wasn't a match) I said no as I couldn't do anything in those 1/2 hrs esp as I didn't know they would happen until the day like I could do on a full day off.

So yes although hard a business head is what you need, hopefully your next job will be great and you will have bosses who don't take advantage.

Well am writing resignation letter now. Shall just say this is my four weeks notice. No need to write anything flowery about the children (children can't read) or unflowery about Mum it is off ducks back with her.
When 'we' tried to resolve issues, starting back in December, nothing changed. Why on earth did I expect her to have more empathy! Doh!!!!

Resignation in. Received email. I owe her 13 hours so she is deducting £130 from final pay. I get £220 a week.

You really need to work it out. It is possible that you do owe them some money back if they have paid salary split over 12 months and do more hours in school holiday time than term time.

Can you prove you don't owe it? Can they prove you do?

Not worth a legal battle over that amount, far too many fees involved. Come to an agreement you can both settle on.

To be honest it it's their penny pinching. I have worked for them for 20 months. I did a very good job they told me. I also did my best to help them out with extra hours when I had no obligation to. I was too nice! As soon as I told them I was going to look for another job they turned nasty. I love the job but I hate waiting for them to come home at night. It is worst part of day. Mum always manages to make me feel crap.
