Au pair and second job

I've had an aupair for about 9 months and she is an EU citizen. She works 25 hours per week and I pay her £80. She would like to stay in the UK and has started applying for second jobs to fit within school hours and Saturdays.

I assume she is allowed to work a second job as she is not here on an "au pair" specific visa? Will I need to start paying her tax and national insurance - how does this work? Thanks

She can have a second job as an EU national. I maybe worth registering with HMRC and running their software for PAYE so you get her tax free allowance, I do this for my AP.

I am already a registered employer for other staff I just in her through my payroll, but she is beneath tax and NI threshold. However, her primary tax code is with so if she gets a second job I still pay no tax or NI on what she earns with me.

Thanks for the link. Does it mean that if she gets a second job I should register as an employer so her earning money from a second job will not have any tax or NI implications for me?

My worry is having an au pair take a second job and me ending up with a tax or NI bill on her wages from second job.

Slightly off topic but thought I'd add. My current really great ap took a second job. The job was in a pub so involved late nights and she soon found she had no weekends free and was very tired on a Monday morning which then affected us all. So while I'm all for second jobs I'd steer any future APs to daytime only roles.

You don't have to do anything with it as she earns under the lower earning level for NI with you. Just keep it in a safe place & make a note of how much you pay her.

That way if she takes on another job she has to sign another P46 with them stating its her 2nd job & they are the ones who have to register/sort her tax, not you.

It's different for Lonecat because if you are already an employer you have to run PAYE & submit RTI returns even if someone earns under the level.

Sorry ladies, if your au pair takes a second job and that knocks her over the tax bracket you will have to register her. We had this last year with ours - simply done as you have payroll already but maybe not what your au pair wanted to hear
