CM Club - can anyone advise my sister?

My sister is changing her CM for a variety of reasons and has found a lovely one just round the corner from where she lives. My nephew is due to start with her from beginning of September. CM has DS who is due to start in Reception and, because he doesn't start full time until 25 Sept, the CM has told my sister she can't have my nephew until then as she would have too many under 5s (my nephew will be 3 and going to pre school 3 mornings)
I'm sure I've read a thread about this before but I couldn't find it anywhere. Would OFSTED make any exceptions for this situation? I'm sure it muct be very common with primary schools having so many staggered entries for Reception children.

When my own son was 4 but in reception he wasn't classed as an under 5 because he attended full time school.
I'm sure this is the case for everyone, or so i was lead to believe by my ofsted inspector.

for the sake of 3weeks, I'm sure the cm could contact ofsted for a change of her registration for this period - she'd have to write explaining situation and how she intends to manage the situation.

my cm has done so for one afternoon a week when she is one over her numbers for a short period - (june until sept)

I think she will be unluckey

OFSTED is unlikely to make an exception for "new Business" the minder is right

Her child will only be a rising five (and move to the next age range) once he attends school full time

A variation could be applied for, however, I agree with Katymac that it would probably be refused. From the information given, I feel there is insufficient reason for it to be approved... there is no continuity of care, no sibling relationship etc.

I guess Aunty Tommy the SAHM will be seeing wuite alot of nephew for the first few weeks of September - I think it will be a sharing out around the family thing until the CM's son goes to school!

i would go with cm on this one dont want anyone phoning ofsted to report her for being over numbers for the sake of a few weeks
cm will feel better and the relationship will start off on a good note
