Childminder contract

I am planning to use a childminder registered with OFSTED. It will only be for 1 hour every day (5 days a week during school terms) so they do breakfast and school drop off.

  • contract states that "we agree to pay half the fee for 2 weeks (pro rata) per year". Does this section apply to us if we only use her service 1 hour per day? And if yes, what would be the pro rata?
  • contract states that she is entitled to 5 weeks holidays. Again, considering that we use her services for only 1 hour per day, do we have to pay for the 5 weeks?

I think you should ask the childminder. Every childminder has their own contracts and if you are having a term time only contract then some of these things may or may not apply.

It would make half fees of whatever you pay her over the course of two weeks. So in that case it would be 5 hours worth fees a year. Pro rata means over the course of a year ... so if you leave after 6 months she should be entitled to only half of that if she took more than that she should refund.
She's earning 0.8333333 day's worth of holiday a month ... 10 days a year/ 12 months = 0.8333333 day

The second point you have to clear with her as it is taken out of context and it just depends what the rest of the contract says. But taking what you wrote in the first paragraph it seems that she can take up to 5 weeks a year 2 of which she would charge you half rate. The other 3 weeks could be at no fee or full fee (depending what the contract says - ask her)
