Made redundant & want my wages!!

Was made redundant - was promised my last pay would be in my account today (1st of the month was my usual pay date)& it's not. I've tried calling 6 times & text 3 times asking where it is as I need it (bills come out tomorrow) I've had no response.

Starting to think I'm not going to get it - small claims court is calling I think

Stressing now as have no money Sad

Why can't people pay up when they say they will??AngryAngryAngryAngry

Annoying isn't it! BUT, it is a Sunday and may be possible that it'll go in tomorrow, depends on the bank and what system your employers use. So check again tomorrow.

Still no money

Managed to contact her and this is her excuse

'You know my new job is far away so my petrol usage has gone up therefore I can't afford to pay you until next pay day'

Going to CAB & will be submitting the online form for the small claims court as when I spoke to CAB last week that's what they suggested

Before submitting the online claim form you will have toshshow that you have given them formal notification of non payment ie a letter with a timeframe for which they have to pay, prior to submitting to small claims track. You will also have to pay a fee to submit which is non returnable so it will cost you to do this. I would try a formal letter first and hopefully they will pay up. Sorry your having trouble as an employer not paying wages on time is unacceptable.

Might be worth a letter saying you will be starting a small claims claim if you have not received payment by say Wednesday and then you will of given formal notice of requiring payment by a certain date and also made them aware that you will start proceedings against them on Thursday if they haven't paid you.

Do you have nanny insurance? If they have a legal line call that.

I'd also send a letter by registered post notifying her of your intention to take her to small claims and (crucially) offering some kind of payment plan to show willing.

Do you have your final payslip?

You would still need to send a letter demanding payment as bith eeyore12 and I have both suggested. Your employers comments are not in writing and it is your word against their. I would get stuff in writing to make your case stronger. Also bear in mind that small claims track can take months so a letter threatening this action may be all you need.

Small claims court procedure website gives details of what actions the court expects you to have done and trying to resolve things between yourselves is something you should have tried. So I agree that you need to formally set out what you feel is owed and give a timescale for when it must be paid by.

Do you have a written contract of employment?
Do you have payslips from previous times this employer has paid you?
As your employment has now come to an end, do you have any written documentation with regard to the redundancy?

Do you have your P60 from around May this year?

The more evidence you have to say that a pay agreement was in place the better. Small claims court to my knowledge relies a lot on the paper trail, so the more of a paper trail you have the better, otherwise it comes down to their word against yours.

Not a great situation, do you have savings to live off for a while whilst you find another job?
