Interviewing first nanny - a few Q s

I am meeting the first nanny today, she would bring her own DS to work with her (I think this could be a positive but will remain to be seen when we meet her) but I have a couple of Q's

  1. She wants to be self employed to enable her to work other places easily, she will only be with us 2.5 days a week, I am not sure on the legalities of this as I know self employed doesn't usually cover set hours at one place of work. However,I used to work at a spa 5 days a week and was self employed (although this was 10 years ago!) so I assume the law has changed? Am I in murky grey water if I agree to self employed?
  1. What would it be reasonable to ask her to provide by way of references and right to work in the UK?
  1. Ay top tips of things to ask/observe?

If days are fixed, hours are fixed DO NOT agree to paying them as self employed. It is your responsibility to get employment status right, get it wrong and you will be the one who gets fined. Contact HMRC Status Customer Service team for advice.

Thank you. That was my gut feeling

It's a minefield!!

You need to confirm that they have a right to work in the UK. I think the ukba website has details of the things to check, such as passport, driving license, any other official documents which can be used for ID purposes.
Do you have reason to suspect they are not allowed to work in the UK?

Certainly follow up references, by phone if possible, certainly the last employer. Try to get a feel for if the previous employer would employ them again. Ask about time taken off work.

Try to trust your gut instincts. If there is a niggle, there is a reason for that so talk about anything your gut instinct hints may not be 100%.

Not sure why they would want to be self employed. Most nannies are wanting parents to do things right and employ them under a contract. So already a bit iffy if they are suggesting that they want to be self employed.

Thanks Cindy. She had recently moved to the UK (non EU) so I wanted to be sure. It is moot anyway now as she is t right for us
