I had a visit this morning from Ofsted. They came to investigate a complaint that was made against me. It turns out it was a case of mistaken identity and was not me at all. Yet this complaint will still go on my record and will show on my next Ofsted report. How is this possible? It was not me yet it will not say that on the report just that the investigation is closed. How BLOODY UNFAIR is that???????

That's bang out of order. There must be something that can be done in the name of common sense.

I know of a similar problem - a childminder made a complaint against another childminder supposedly using a parent's name and details (so every time Ofsted contacted the complainer, they were talking to the Horrid Childminder!!) Ofsted were unable to establish the facts of the case, so it remained on file (with the Nice Childminder's letter refuting the complaint).

It came to light many many months later, when the parent found out that she had apparently made the complaint. She rang and wrote to Ofsted to say that it was the Horrid Childminder making malicious comments, and that she had never ever made this complaint. Ofsted accepted all this but, as with you Unjust, it remains on file!!

I don't know how to deal with this officially, but I would certainly contact the NCMA in the first instance and take advice.

Do they know who the actual person is who should have been complained about?

Unjust, I would tell the childminder friend what is coming. My loyalty would be with my friend, not the ofsted reprter who was putting a complaint on my record which was never actually made against me. Do unto other as they do unto me.

I agree and will do exactly as I want, like you say why should I do them any favours they are not going to do me any. Tommorrow I find out if I have the right of appeal but its not looking hopeful. Although my DO said she will help me take it all the way the DFes if need be. Put it this way if I was questioned by the police yesterday and not Ofsted then would I have a criminal record? No I thought not but I have a public record on my report.

I'm not a childminder but I can't see how the laws of libel don't apply here. If it goes on your Ofstead report it will mean that something has been published about you that means people may think worse of you because of what is written which is the definition of libel. Personally I would take advice from a solicitor.

Thanks for that. I think I may actually go down that route as things are not looking too good at having the allegation removed.I am waiting for a Duty Managers decision at Ofsted. I will give them until Monday to get back to me. Also started official complaints procedure which I have to give them 20days to get back to me but I may take solicitors advice before then just in case.
