Nanny annual leave. Does this sound right amount?

Took advice from local nanny agency when employing nanny 2 days per week.
Nanny works Monday and Tuesdays. Advised to give 4 weeks annual leave plus public holidays, which amounts to around 10 public holidays per annum. Is this correct or can we ask that she uses annual leave for some of the public holiday days?

Legally you have to give 5.6 weeks pro rata. So working 2 days means she will be entitled to 11.2 days holidays which can include the bank holidays. Also, this cannot be rounded down but does not have to be rounded up. Hope that all makes sense!

If her contract says 4 weeks plus public holidays, then that is what she is entitled to. However, bear in mind that won't be 10 days given her working days. There are 9 public holidays this year, and at least Good Friday will have been a Friday.

However, if you are still at the negotiation stage, or change nanny, yes, you could pro-rate the public holidays. So 2/5ths of 9. Where you have a nanny who works Mondays and Tuesdays only, a disproportionate number of bank holidays fall on a Monday, so she would have a short fall. You can negotiate whether those are used out of holiday, are unpaid, or are dealt with some other way.

Statutory leave is 22 days, so just pro rata that. I think the bank holidays are at your discretion in addition to that minimum.

It's 28 days now actually. Agree you can use bank holidays towards that minimum.

However, I would still like to flag up that the OP has talked about setting the nanny's contract in the past tense. If the contract is already in place, it doesn't matter what the law says. If she has offered more she has to honour it.

You pro rata the bank holidays too. I work one day a week and am entitled to two bank holidays.
