Calculating Holidays

Many thanks to everyone who responded on my previous threads, the advice has been invaluable. I have found a lovely nanny who has agreed to work 2 days a week.

Have worked out her annual holiday entitlement as 11.2 days (rounded up to 11.5 days). As most of the bank holidays fall on a monday or tuesday ...

Tuesday 25th December
Tuesday 1st January
Monday 1st April
Monday 6th May
Monday 27th May
Monday 26th August

Would it be fair to ask her to take these off (both my husband and I never have to work bank holidays) and let her choose the other 4.5 days. Is this the usual way of doing things or do we just pick half each?

As a bit of further background we are likely to take off at least another 4 weeks (equiv 8 days to her) for which she would not be needed but we would pay her.

I'm sure someone else will be on in a minute who knows this for definite, but I'm pretty sure annual leave is in addition to BH, so I don't think you can do that.

Happy to be corrected if I am wrong.

Which says employees are entitled to 5.6 weeks leave including bank holidays (4 weeks paid leave PLUS 8 bank holidays). She will be working for another family three days a week so my 11.5 plus their 17 takes it to 28.5 days in total.

As I said, we will probably offering another 8 days fully paid but do not want to include that contractually just in case something crops up that I haven't foreseen. I think it just appears that we are being mean because all the Bank holidays fall in our part of the week, which is why I wanted to check we are calculating it right.

That sounds fair and complies with the statutory minimum requirement of 5.6 weeks. I'd be inclined to let her choose only 3 days this year as she can still make this 2 weeks by choosing a bank holiday week.

Her bigger problem is likely to be her other employer - if they make the same mistake as coffeeandwine they may try to get away with 4 weeks plus good Friday i.e. 13 days instead of the 16.8 she is entitled to as a minimum.

Our Nanny is FT, so working out holiday entitlement is a lot easier. Grin wonders if I now need to check we are giving her the correct amount of holiday

I did tell her that the way I had worked it out she was entitled to 11.5 from me and 17 days from her other employer and she should check her contract from them. She is only young and I these are are her first full time nannying positions (previously experience in a nursery setting) so I want to make sure she is aware of her entitlements. As I said previously, I will be giving her paid leave for any extra holiday we take and she is not needed, which should be around another 8 days (which equates to another 4 weeks off) and am sure that she will be happy with that.

I remember being that young (oh so long ago!) and feel responsible for ensuring she is aware of what she is entitled to.

For those who may read this who answered my previous thread I ended up offering 8.00ph rising to 8.50ph after probation and a review six months after that which she was happy with. Sorry if TMI but I always like to know the conclusion to a thread and as everyone that answered my previous questions was instrumental in the outcome! She is lovely and have everything crossed it all works out.

Now my only worry is tax codes ... MrAnchovy I may be calling on your expertise ...
