What are the PITFALLS of hiring a Live Out NANNY??????

Been thinking about hiring a live OUT Nanny but am worried about a few things. Grateful for any advise.

  1. Are Nannies entitled to Maternity Pay?
  2. Are they entitled to sick pay?
  3. How much notice do you have to give them?
  4. What are the H&S implications if your home is now a place of work?
  5. Do you have to get special insurance?

Any other things I should consider?

If you need the strict legal position, I'd suggest you talk to nannytax or have a look at bestbear.co.uk, which has a model contract and may explain what the legal essentials are. I can tell you what practice is on 1-3:

  1. Yes - statutory amount, claim it back from Govt.
  2. Yes.
  3. Depends on what you've put in the contract - we have a one-month notice period & either side can give it. There is probably a one-week minimum which kicks in after employment has continued for certain length of time, but (as above) I'm not sure of the strict legal basics - just because, I think, practice is that nanny terms of employment are in most ways a bit more generous than whatever the minimum is.

  1. Yes, but you can write a six month fixed term contract. It ends at the end of 6 months and that's that. You can wrote a new fixed term contract when it ends.
  1. Yes, but SSP doesn't amount to much and doesn't kick in until the third day of absense.
  1. Whatever you put in your contract. I think it's 4 weeks if not mentioned in the contract.
  1. No idea.
  1. I don't think it's required.

Oh, live-out nannies statistically take more sick days than live-in. There's a pitfall for you.

Thanks everyone. I still don't know what to do. Have found a great nursery where a friend works but I have a 6yr old boy who will need looking after during school holidays. Not such a problem after school as DP works at home most days.
Average price for Nannies around here is 70-80 a day which is a lot.
