Nanny holiday entitlement

I'm aware that in the UK works receive a minimum of 5.6 weeks of paid holidays a year (i.e. 28 days for a 5 day week).
My nanny, however, will work 6 days a week (Mon - Sat) and I read on directgov.uk that holidays are capped at a statutory maximum of 28 days for all working patterns (including 6 day weeks).

Will she be entitled to 28 or 33.6 (5.6x5.6) paid days off?

Many thanks!!

The statutory entitlement is indeed capped at 28 days, which is only 4 and a half weeks for your nanny.

I'd say that as a decent employer aiming to foster a positive relationship with your employee and wanting her to have a positive attitude to you and to her work, it would be better to go beyond the statutory minimum and let her have 33 days paid days off.

You are entitled to set down some rules for limiting the options for when she can take her holiday and how much notice she has to give you to allow you to get other childcare in place.

I don't read that as including 6 day weeks - I read that as working patterns eg shifts involving nights and weekends.

Working on an accrual basis she would be entitled to your higher figure.

Is your nanny working regular set hours? Might it make sense to calculate the holiday in terms of hours if there are half days involved?

[http://www.acas.org.uk/CHttpHandler.ashx?id=955&p=0 Acas: Holiday Pay Leaflet (pdf)]] provides a bit more info, though yes Statutory Holiday is capped at 28 days. However you can offer more holiday than statutory minimum.

Are all days equal length? If not, then you may be better calculating holiday in Hours, rather than days.

Thank you very much for all your answers. I think I'll calculate it terms of hours, since she works less on Saturdays.

I'm very impressed that you have found a nanny who is prepared to work 6 days per week. Maybe I'm just getting old and like my 4 day week Grin

3 days are better nick lol Grin

i was told about a job that wanted 3 week days plus every sat and i said no

op - it would be nice for better working conditions to allow / give your nanny extra holiday if you can afford it - considering she will only get 52 days off a year (suns) iyswim
