what do you put in a notice to terminate a contract if there is not a problem but a new child is due to start and the space has been taken up? even though child is due to leave in July 2012?
please help!:)

I personally would not terminate in that case as it will just make a bad impression and could potentially harm my business in the future as most of my children come from word of mouth. I would apply for a variation in that case.
Otherwise in letter of termination just say 'due to change of circumstances'.

I wouldn't take a child on who takes up a space that is already taken, I'd ask the new starter to hang on until the space is vacated or if that's not possible I'd seek a variation.

HolyCameraConfusionBatman · 07/05/2012 16:52

You want to give notice to a child that you currently care for because another child has come along and you need the space?!

That's terrible.

insancerre · 07/05/2012 16:57

So you have a child who is leaving in July but you want them to leave earlier because you have filled their place already?
That's a bit unfair. What are the parents supposed to do? I presume they need the place till July?
Can you not delay the new starter until you have the place available?

nannynick · 07/05/2012 17:22

even though child is due to leave in July 2012

How are they due to leave ? Have they given notice?

When does the new child need to start... September, or earlier?

minderjinx · 07/05/2012 19:13

I may be wrong, but I don't think she meant she was getting rid of one child to take on another.

I have what I think may be a similar situation. One of my little ones is leaving in July = all perfectly amicable, Mum is going on maternity leave then. I have someone else willing to take up the place, but strictly speaking I can't offer them a contract until either my other Mum gives me notice or I serve notice on her. We discussed and I agreed to give her notice to save her the trouble of writing a letter - nothing terrible or underhand about it, just paperwork.

minderjinx · 07/05/2012 19:16

Sorry, just to clarify, I meant I am about to give her notice effective at the end of July, so I can now offer the new family a contrcat effective from August.

HSMM · 07/05/2012 19:20

Do you have anything from the parents in writing to let you know that the child is leaving at the end of July? If you do, then you don't have to give them notice, because they have already given it to you.

If not, write them a letter to confirm that is what they want and ask them to sign it and return it.

HSMM · 07/05/2012 19:20

In fact ... you might have a verbal contract that the child leaves at the end of July ?????

gotkidz · 07/05/2012 20:20

hi, yes minderjinx is correct, I'm not getting rid of a child, I know they are leaving to go to school, but this was meant to be September,(mum told me) but have been told by another minder that she has signed her for an earlier date beginning of Aug and has a sign contract and deposit.
But new child has got till August to take on the space, I will have to do variation, thats not a problem if they require space earlier, but as mum hasnt told me and I have been told by other minder, I wasn't sure if I should give her notice or carry on regardless.
I wouldnt actually eliminate a child in my care and leave mum with no options, I was just sort of wondering what wise words people could share with me!:)
