Can I pay a nursing assistant who isnt Ofsed registered to pay for my child in my own home?

I'm just wondering what the rules and regs are for paying a nurse to look after my 9 month old son in my own home one or two days a week. The lady I'm thinking of using has travelled here from portugal in order to get work.Her huband and two young children are coming over here in April. She has a part time job at a local nursing home but wants to earn some extra income as a babysitter / nanny. And how much should I pay her if she is caring for my son on his own or bringing her toddler with her? She as an updated CRB but no nanny or childcare qualifications - but is a mother of 2!

Ooops - meant to say CARE for my child in my own home. I'm an over-tired donut head.

You can pay anyone you like to care for your children in your own home. You are her employer though and need to provide a contract and paid holiday (5.6 weeks a year including bank holidays).

You need to pay at least minimum wage which is about £6.08 an hour I think. As she has another job, you need to register as an employer with HMRC and deduct tax and NI from her pay, and pay employer's NI, and provide her with payslips. There are Nanny tax companies that will take care of this for you if you prefer.

If you employ someone you have the same responsibilities as any other employer.
