Redundancy Issues (again)

I'll try and keep this brief

So made redundant a few weeks ago, boss emailed me with my 'figures', she says £320 redundancy, no holiday pay (which I then work out is right, I'm .08 of a day short of being owed a day's money!) and SMP til end of July.

I reply said redundancy should be £399 as its GROSS weekly wage x 2 not net as its not a taxable payment.

And I get this as my reply.

[i]The reduncancy pay is tax free meaning we don't need to
pay the usual tax on this amount. Therefore it remains at
£320 seeing as we have always paid you net (at your
request). It will be paid at the start of your reduncancy.
Also we are owed 2 days annual leave seeing as your leave
runs to May and your reduncancy starts in February. We
will need to deduct this.[/i]

NO idea how we've come to the fact that I owe her holiday: we did pro-rata it the first year as I started in May but in 2011 & 2011 we started the year with 8 days (4 each) written in the diary and ticked them off. We were at 0 at the end of last year and none has been taken this year.

Last year since May my holiday was:
Their choice: 25/7, 27/7, 1/8, 8/8, 5/9
My choice: 19/9, 7/11 & 9/11

So it seems the goal posts have changed and this me owing them holiday was never mentioned in the original email. I've just checked my contract and it doesn't actually state it runs from Jan - Dec so I guess I'm screwed.

To be completely honest I don't think I can be bothered to fight it out - I've got so much more to worry about but it is a b*tch only getting £160 (after deductions for 2 days holiday) instead of the £400 I thought I was owed.

Sh*t happens I guess.

It is free to go to the small claims court and she, as the employer, would be expected to know what she is doing, so the slightest mistake on her part would be upheld for you. Sounds poo. Good luck.
