I am due to employ a nanny for my 14 month old dd. She is likely to take maternity leave in the next year or so. I know there is an obligation to keep open a nanny's job for them-but if I make alternative arrangements for DD during mat leave ie. by sending her to nursery-and this suited her better than being cared for st home by a nanny-would I be obliged to remove dd from nursery to be looked after at home by nanny when she returned to work?

If following the end of maternity leave, if the job no longer exists, then I would expect that you could make your nanny redundant. As you only have the one employee, there isn't a trouble in terms of selecting an employee to be made redundant.

The DTI have some information regarding \link{http://www.dti.gov.uk/er/individual/mat-pl958c.htm#s9}Redundancy while on Maternity Leave} Particular things must be done, so that you do not end up in an unlawful situation, as making an employee redundant while on maternity leave is unlawful unless certain requirements are met.

If you make your employee redundant while on maternity leave, you will need to pay in lieu of notice. You may also need to pay redundancy, depending on length of service.

thankyou for that nannynick-all I am concerned about is the minimal disruption to DD.
