We took on a new nanny 10 months ago and we simply don't get on. We have no grounds to sack her and we can't make her redundant as the job will still exist. Can we simply tell her it's not working and give her a month's notice?

Why don't you get on? The chances are she's not enjoying it either - can you have a review chat and seek to make changes or agree with her to let her go?

What does your contract say?

Tell her now and, unless they are inherently discriminatory, tell her the reasons. Once she has been with you a year, she will gain protection from unfair dismissal and you will be significantly more at risk if you sack her.

Yes you can at this point. You can give notice as per the time period specified in the contract.
However you will be expected to provide a written reference and respond to verbal reference requests. So you need to be clear as to why you are terminating the agreement.

What will you do for childcare if your nanny leaves now, or after working a months notice period?
