If I have a nanny, and she has an accident at my property, could she claim compensation from me?

Just wondering if that is possible, if she has an accident at my house during working hours can she claim compensation from me? What would happen if she was injured?

My nanny has just started working for me, and I have just found out I will have to pay her NI etc, and I have no clue how to go about this... Confused

Hi happenedagain,
I know nothing about NI contributions.

About the insurance....
Yes she could, but as an aside, any guest in your home could or the postman who trips up the front step.
You need employer liability insurance ideally however, if you speak to your home insurance first you may be covered already for guests and this may extend to the nanny.

If you have no insurance you will be personally liable, this means that whatever award a court gives her, you will have to pay personally, regardless of whether you can afford it (so worse case, you could lose your assets). Obviously this would only happen if a serious accident occurred i.e. the house collapsed, she broke her neck and she needed 24 hour care etc.

Yes, I would say that if you were liable for whatever caused the accident, then a claim could be made. That is why you have Employers Liability Insurance (this is part of your home insurance policy... check with your insurer as to what they cover).

Note: I am not legally trained... so seek legal advice if you need it.

NI is totally different... that is part of UK taxation. You as the employer have to pay: Employers NI. You are also responsible for deducting Employees NI and Employees Income Tax.

Details can be found on the HMRC website - HMRC: PAYE Intro

You can use a payroll company to help with the admin, such as calculating the deductions, producing a payslip, reporting figures to HMRC, plus they will prompt you to payover the money to HMRC every 3 months (as per the way that HMRC like to get the money).
There are various payroll companies around... PAYEforNannies currently does my payslips... they seem to get them right.
