how to let the lovely filipino nanny housekeeper go

I have a lovely hardworking filipino nanny-housekeeper and we have just renewed her domestic visa till July next year. Sadly due to a cut in LA funding and our special needs requirements, dh and I have decided that it's in our family's best interests to let her go. She has been a godsend but we have been told that our direct payment can no longer be used to pay for some of the time she spends looking after ds1 as it no longer qualifies as respite. Our family's childcare needs have also become more complex and specialised with ds1's ASD (he's getting bigger and stronger).

We have worked out that it's affordable and easier for us if dh works 9.30am - 2.30pm to fit in with ds1's school day while we get a cm for ds2 who is in preschool 15hrs a week. we can pay for it with childcare vouchers which will be cheaper for us.

The real problem is how to break this news to the nanny and mitigate the effect. she's been employed for less than 1 year.

Any suggestions will be most welcome. If anyone needs a nanny-housekeeper in the greater london area, please let me know.

In terms of termination, tell them that the situation has changed. Write them a letter setting out reason for termination and how final pay has been calculated (such as pay for holiday not taken, notice pay as per contract, last working date).
Check with UKBA with regard to if Visa can be transferred to another employer - I don't think it can, but do check the conditions. Assist with arranging flight back, write them a lovey reference and provide phone number which future employers can call to verify the reference.

I think the best thing you could do for her is help her find another job. Maybe register her with some agencies.

Does she live-in? If so could you let her stay until she finds something else.

I don't know why DP can no longer be used tbh. Some families had their DP reduced due to funding cuts but ds1 attacked the social worker from the moment she arrived till she left and she said she wouldn't reduce ours. the letter I was sent just stated that it didn't fit their definition of respite care and that I was to refund the money spent back into the account. i have called a few times and challenged them to define respite but they have been fobbing me off. the lady who granted the DP and agreed to my hiring her has 'left the service'.

The visa is definitely transferable and doesn't have our name on it. Her home office says something about her only being able to take up another job in a domestic setting.

I saw a panorama/dispatcehes type programme where people were abusing their (mainly) filipino nannies and were under the impression the nanny couldn't work for anyone else because they helped get the visa for their nanny and thought therefore they were entitled to keep the passport/them (NOT true).

It was really horrific actually. Some staff were working for diplomats who were immune from prosecution for abuse. One woman was so scared she wouldn't leave employment cos the diplomat tracked down and threatened her relative's life if she left/identified him; the police/courts could do nothing!

You can only be honest with her. And make sure she goes to a good family!

Interesting what you say about DPs... hope HampshireSS don't start taking that view.

Chapter5 Section 12 - seems like she can change employer but must still fit the category, so another position very similar should be OK. She has to "inform the Immigration and Nationality
Directorate by letter of any change of employer at the earliest opportunity. The following information should be provided:
? Full name and date of birth as in passport
? Where and when entry clearance was issued
? Details of original employer
? Details of new employer
? Reasons for change"

I'm in essex. I suspect that SS may be taking that view because they have a new manager who wasn't involved when we agreed that DP could be used as part payment of her wages. They know that i have 2 dcs and verbally agreed that the DP could be used to cover about a third of her weekly wages. Maybe things would have been different if I'd put her on two contracts - one for DP and one for the self-funded bit.

I'm sure she's wiser than she lets on when it comes to her rights in the uk. both of her sisters work as housekeepers for MPs and they all go off to london on friday for the weekend.

If she has SN experience then point her in the direction of SNAP Childcare. She is likely to get more p\h doing SN work (if that's what she wants to do of course).

Can i ask what is the rate for live in housekeeper? I just started another thread as our maid has been with us for almost a year and we would love for her to join us in London (if she wanted to...) but am not sure we can afford it.
