nanny or babysitter?

I've arranged for a nanny to provide after school care for DS for one day per week (3 hours total), and she will bring her own child with her for that time. She already has a job working three full days a week as a nanny, and in addition, does ad hoc evening babysitting for other families. I am unclear as to whether the care she will provide for DS will be classed as nannying (i.e. employed by us) or babysitting (i.e. self employed). Please could someone help to clarify?

If it is a regular weekly thing then I would suspect that a status officer would see that being more Employment than self-employed as it is not ad-hoc. However they may look at the overall picture of all employments the person does and thus may conclude that it would qualify as self employed.

guess tech she would be a nanny but you could call her a babysitter and as only 3hrs a week the amount you pay her wouldn't reach the tax threshold and although I would never advise someone to pay cih for the little amount you would pay the nanny doesn't seem worth declaring it

Many thanks for your replies nannynick & Blondes - it seems this may be a grey area. I suggested initially that we register it as her second nanny job, but she said she would prefer to treat the 3 hours as additional babysitting. I am paying her the rate she receives for babysitting, and assume she will go through the appropriate channels to declare the income. Is it my responsibility to ensure this is the case? Also, she has offered to provide holiday cover, which will increase the hours to approximately 10 per week. I wonder if this would change the position?
