I would like to employ a girl for 3 days a week but avlble for 5,she is charging 8 pounds an hour.Could she class herself as self employed and would have to sort out her own tax and paye.Thanks in advance

Not a tax expert -

No, she cannot be SE for this type of job. You will need to employ her - which will entail paying her a net amount after you have deducted the tax and ni due from her gross wage. You will also pay employers ni and will need to pay her holiday pay (currently 16.8 days for a 3 day a week job - this can be rounded up but not down and bank holidays can be taken out of those days).

Never assume someone can be self employed. There are many factors in determining employment status and for a nanny it's unlikely that they would be self employed if doing regular work for one client.

Therefore operate PAYE and agree a Gross (before employee Tax/NI deductions) salary.
The contract can be for the main 3 days... so a fixed number of Minimum Hours per week. Then consider what happens for the other days... would you insist they are available, or would you be taking pot luck as to them being available when you ask them to work?
