just curious - has anyone taken hosp to court for awful labour?

My DP says i should because they cocked up a few things during my delivery and as a result i ended up with an emergency c-section...
but i dont see the point of doing it because, we cant rewind the past and what is done is done.

I want to read my labour notes to see their side of the story but im not sure i'll agree with them anyway.. on some paper they gave me they wrote "failure to progress" as the cause to my c-section... and it is not... i was progressing well until they messed up...

Is this a recent birth? Has your child experienced problems due to the birth?

If it's been a recent event, then I would be inclined to leave it a while before seeking notes etc. Time is a great healer and when your life/body starts to return to normal this might not be as much of an issue for you.

If your child has been affected by the birth then that's a completely different issue.

Births don't often go exactly according to plan for whatever reason, but sometimes it can make us more determined to seek a different birth for our next pregnancy, as it did for me.

Other than issues over consent or clinical negligence I don't think you'd have a hope in court.

It might be a good idea to seek some counselling for birth trauma, especially if you and your partner are struggling with the birth experience you have had and it occurred some time ago.

You could, but you probably won't win. Because they did the C-section, that shows they did everything they could to help you and your baby. That's why a lot of Ob/GYNs here in the US are C-section happy.
