PIP Tribunal..advice?

I have a virtual tribunal for DD with ASC ADHD and Anxiety..out of school for 3 years and 17...she has to score 12 points to qualify for PIP and initially got 10. So have appealed..will she need to be in the tribunal as very anxious?

Are you DD's appointee?

10 points would give standard mobility or care.

Yes I am her appointee...yes she gets basic ..but when I applied she hadn't had ASC and ADHD diagnosis and I should have answered questions based on her bad days...where she doesn't eve go to the loo unless I tell her and lives in a darken room.

When I helped my friend prepare her case last year the advice on the Benefit and Work forum was to write to the Tribunal Service requesting you attend in place of the claimant. And since she was, like you, her DC's appointee it should be accepted by the Judge.

In the end my friend did take her DC, but they didn't speak and cried. It may seem cruel but she was also advised that it can help if the panel see them overwhelmed.

Have you thought about applying for an EHCP?

Thank you I will ask to speak instead. We applied for EHCP, with lots of medical= CAMHS support but were turned down due to not enought information from school...which she hasn't been to in 3 years..
Appealing that too!

Good luck appealing both the PIP and EHCP at the same time. Stressful is an understatement!

If you need support/ advice with the EHCP tribunal the SN boards are helpful. IPSEA and SOSSEN are brilliant too.

Do you know which activities you need to increase points on to go up a level. If so, concentrate on those. They should take into account the diagnoses you have now. Try and get the paperwork to them before the tribunal.
If you are her appointee she doesn’t have to be at the tribunal but as above although harsh it is really helpful if they can see the state she gets in.
You need to move up from needing prompting for the washing, dressing activities to actually needing help and support to do it
