Used Evoque Rejection

I purchased a 2017 Evoque from an independent Hyundai dealership on the 29th December. Within 24 hours I found that it had the following issues:

  • cracked rear light
  • heated windscreen did not work
  • 360 camera system did not work
  • the engine whistled when you accelerate and move through the gears
  • there is a grinding noise and feeling when you turn a right corner or junction

I emailed them about this on the 30th December. They had the car back for a week from the 6th January and fixed the windscreen, camera and light but not the whistling noise and said there was not a problem with it. They did not mention they did not mention the steering.

I then took the car to 2 local garages and they both said the whistling sound was not normal. Oberon a diagnostic report and it found 22 error codes.

I told the Hyundai dealership that I wanted to reject the car because it was within my first 30 days of purchase. They said they would need to look at the car again and took the car back again. They have now had it since the 20th January.

They have cleared all the error/fault codes and said that because an engine light has not come on since they have cleared them they are just historical. They have also said that the engine is whistling but because the car is not new and has done 45,000 this is part of wear and tear and I should not expect a car of this age and mileage to sound normal. They have told me that they think the noise is a bearing in a telephone conversation and in an email they have said that they think it is coming from the turbo. They have said because there are no engine lights coming on the car has to come back to me.

I am not sure what to do next. I do not agree that this is normal at all. At the moment I have their courtesy car and if I say I am not having the car back and they don’t refund me I will not be able to get to work.

I paid a £250 deposit on my credit card and the rest by electronic transfer.

I am just so stressed out by it all.

Sorry to hear of your troubles - but I have to ask - what on Earth possessed you to buy a near decade old car - and one that is so unreliable and junk like a JLR product?

All JLR products are fucking shite and sit at the bottom of reliability charts for a reason.

If they dont honour your rejection, if they say the car is "fixed", bite the bullet and trade it in for something else - something Japanese (not Nissan).

Historically I have had Land Rovers and not had a problem until now. I think they are just not the same as they used to be.

I do not think I will be able to trade it with the noise it is making.

You have a right to a refund under the 2015 consumer rights act as it is not fit for purpose or as described. You do not have to accept a repair and are entitled to reject it under this act.

If they will not do this you need to contact your credit card company and ask them to refund you under Section 75 of the Consumer Credit Act. As long as you’ve paid £100 or more on your credit card; your credit card company should refund you the whole lot of the purchase and then take it up with the retailer. You should also get any consequential losses (eg cost of a hire car) returned to you.

That’s not their choice though. The fact that it’s not as described and not fit for purpose and you’re within the 30 days you can just reject the car without having to give them the opportunity to repair it. It’ll take time but the law is on your side here.

Guessing the 2.0 litre diesel model? Notorious for engine problems (I am a former jlr employee) might be worth looking at balance shafts? This was the biggest one although turbo and timing chain issues also very common!

Be aware if it is the 2 litre diesel you will have no end of dpf problems if your not doing motorway mileage!

Most dealers take in cars for part ex with issues.

Have you actually enquired and asked whether you can trade it in?

Thank you, I am just going to have to keep
pushing for the refund. It is just the time it takes when I really need a car. I think they know this and are hoping I will give up. As I reported the issue to them after having it for 1 day and have said in 3 emails since that I want the refund I do not think there is a lot they can do to avoid it. They have acknowledged that the noise is there but have said they won’t investigate it properly or try to fix it because it would mean having to take the engine apart. I don’t want them to do that, I just want my money back.

Just persevere, you will get in the end. It’s horrible and stressful as for ages you feel like you’re in a worse situation than you would be if you took what they’re offering. stick with the refund request and you’ll get there. And do not take what they are offering as i suspect it’s a matter of time before the car has a complete engine failure

Well done for missing my point.

My point was that the OP could/should/ought to have looked at another brand for a used car, of which there are many which are far more reliable than JLR products.

JLR products are well known for how unreliable and general dogshittedness they are.

We have had excellent JLR cars. Our Discovery is 2011 and only had standard maintenance issues from new. I’d only buy from JLR and not Hyundai though. They presumably got the car in part exchange and hadn’t serviced it properly. I’m amazed at a main dealer selling a 2017 car ad well. Usually they go out to the auctions.

We have had far fewer issues with our JLR cars than friends have had with their cheap and cheerful ones and our Evoque was a great car. We had it ft new though.

The dealership is really not doing themselves any favours, they are now saying they are going to charge me storage fees if I do not collect the car I have rejected. I have spoken to citizens advice and they have confirmed that they need to pay the refund.

The stress of not having a car is really bad.
