Sold motorhome buyer trying to return it after damaging

Hi
so I sold my motorhome last weekend it was in perfect working order, the couple were old and could not drive it they really struggled with the clutch and gears it being a 30yr old truck , I even had to get it off my drive for him gave him the option to refund him before he drove off.

we did sold as seen he was happy with it then decided 2hrs driving it that it wasn’t right (not true realised he couldn’t drive it)

he’s harassed me sent me a money claim invoice that’s not even signed by the courts demanding money (fraud paperwork). If it’s damaged at all then he’s caused it.

as a single mum this is really stressful. Am I liable at all or is he just bullying me? I’m seeing a solicitor next week .

Thank you any help greatly appreciated

If you advertised it as sold as seen and it was working perfectly when they left with valid mot, I can't see what they can really do.

Luciv · 31/01/2025 20:31

Yes all of the above and thank you

If they continue to harass you, call the Police.

They are chancers - their age is irrelevant.

Sunshin80 · 31/01/2025 20:44

He is bullying you. Stand your ground!! Do not even bother with a solicitor don't waste your money. Just because he couldn't drive it isn't your problem. Even if the clutch had gone half his way home, things happen. Stand firm and advise him should he harass you any further you will contact the police. Someone tried this with me and I had to get an injunction against them. Never heard off them after that obviously. He will start to become out of pocket if he goes down a claims court. He will of picked up and printed out something off the Internet to scare you. Failing that if you had a male friend that could give him a call and tell him kindly leave you alone!! If he isn't happy with his purchase then he can sell it himself. Private sellers are mostly cheaper than garages as they don't come with the likes of a warranty or colling off period. He's trying to use you like he's brought of a car trader. It's him that should learn his lesson not you being harassed.

Sold as seen. They are chancers.

redboxer321 · 31/01/2025 21:19

Probably not the first time this 'elderly couple' have pulled a scam.
Agree with pp, don't waste your money on a solicitor, there's no need, these chancers have nothing on you.
It's not even their bad luck (van didn't break down) but their misjudgement (they couldn't drive it).

Shade17 · 02/02/2025 12:00

As long as you didn’t misrepresent it then they haven’t got a leg to stand on.

WomenInConstruction · 02/02/2025 12:02

Ignore. They haven't got a leg to stand on.
You could go to the citizens advice website, they post FAQ 's on common situations (like this)... Sometimes they even have useful template replies, so you can state your position which might shut them up quicker than silence.

Whyherewego · 02/02/2025 12:13

There was a thread à while back from someone in a similar position but with a car.
The facts are that you are not, as a private seller, held to the same standard as a garage. If it has a fault that you knew about and didn't declare it then that's different. But if it was working as far as you were concerned then there's no recourse possible

CatsWhiskerz · 02/02/2025 12:48

I can't see what else you could have done to help before they drove off so ignore them

Mrsbloggz · 02/02/2025 12:49

It sounds as if you can safely ignore them op.

Shade17 · 02/02/2025 12:53

If it has a fault that you knew about and didn't declare it then that's different.

Not true, the onus is on the buyer to satisfy themselves of the condition of the car. The issue only arises if you state that it doesn’t have a particular fault that it does in fact have. If you state in the ad “car is 100% fault free” for example, then you may open yourself up to a claim of misrepresentation.

custardpyjamas · 02/02/2025 12:53

Have they taken it to a garage to be inspected? They could have a case if an inspector says it's unroadworthy or dangerous. If you are confident it was OK when you sold it brazen it out.

Exactly, block him and move on. He won't do anything, keep all relevant documentation and don't let horrible older men intimidate you.

All used cars sold privately ate bought as sold, his choice. 2 weeks later de ides its no good? His job to sell on.

Please block him and forget about the misogynistic assho1e

It is his job to do that before the sale. Not ops problem, she is anxious as it is without adding to her anxiety.

If it had valid mot then there is no problem.

This is just a misogynistic man trying to intimidate and frighten someone .

Tale as old as time.

Don't rise to it op. Just block him and keep the paperwork, you will be fine. Just an absolute grifter you've unfortunately come across.

Do you have any men in family or a friend who can take over correspondence? He will run a mile then

Men like these are cowards.

Did you read the original post? They couldn't even drive it properly.

Mrsbloggz · 02/02/2025 13:14

As said OP, this man thinks that because he is a man you will automatically defer to and obey him. In other words it's a bluff, caveat emptor is the bottom line here.
