Went to my local Superdrug yesterday and saw that they had three packs of infant formula in the clearance section. I didn't really get a good look at them but it looks as though one of them had the outer packaging damaged, so I don't know about the other two.

I let one of the shop assistants know that discounting infant formula is illegal. He seemed a bit confused and asked if I was in retail. I said no, I'm just a nosey mother who knows about stuff like this. He said he'd look into it as it might have been a mistake that it was put in there.

Am I correct in thinking that it was indeed illegal?

The Infant Formula and Follow-on Formula Regulations say:

23.?(1) No person shall at any place where any infant formula is sold by retail?...

(b) make any special display of an infant formula designed to promote sales;...

d) promote the sale of an infant formula by means of premiums, special sales, loss-leaders or tie-in sales; or

(e) undertake any other promotional activity to induce the sale of an infant formula.

But they weren't doing it to promote sales, they were doing it to clear packaging-damaged items, so I would think it wasn't covered by the regulations. You could ask the Baby Feeding Law Group.

Yes, it's illegal. It was there to promote a sale (whatever the state of the packaging - the price was reduced for a quicker sale). It would be legal if the lower price was permanent.

If it was for over 6 month babies, I think it's legal as follow-on milk was invented to get.round the.definition of infant formula.

Boots doesn't give Advantage card points on infant formula (the birth-6 months stuff) as they aren't allowed to promote in and tie it in with 'rewards' for customers.
